1. About These Terms

This website and the Meribuy retail business are operated by Actas, trading as Meribuy ("Meribuy", "we", "us" or "our").

These Terms of Service ("Terms") govern your access to and use of the Meribuy website, online store and related services.

By accessing our website, creating an account, placing an order or purchasing products from us, you agree to these Terms together with any other policies referred to on our website, including our:

  • Privacy Policy;
  • Shipping Policy;
  • Returns, Exchanges & Store Credit Policy; and
  • Billing & Payment Policy.

If there is any inconsistency between these Terms and rights that cannot lawfully be excluded under Australian law, those statutory rights will apply.

Our online store is hosted using the Shopify e-commerce platform.

2. Eligibility and Lawful Use

You must have legal capacity to enter into a binding contract when making a purchase from Meribuy.

If you are under the age required to enter into a contract in your jurisdiction, you should only use the purchasing functions of our website with the involvement and consent of a parent or legal guardian.

3. Orders and Order Acceptance

When you place an order through our website, you are making an offer to purchase the products in your order.

After your order is submitted, you may receive an automatic order acknowledgement or payment confirmation. This confirms that we have received your order but does not necessarily mean that the order has been accepted.

An order is generally accepted once we confirm that it can be fulfilled and proceed with processing or dispatch.

We may contact you or decline an order where reasonably necessary, including where:

  • A product is unavailable;
  • There is an error in product or stock information;
  • Payment cannot be authorised;
  • We reasonably suspect fraud or unauthorised activity;

If we cancel an order after payment has been successfully received and no goods have been supplied, we will refund the relevant amount paid using the original payment method, where reasonably possible.

Products displayed on our website are subject to availability.

Stock levels may change quickly and an item shown as available may occasionally become unavailable before an order is processed.

Where an ordered product is unavailable, we may:

  • Contact you to offer an appropriate alternative;
  • Provide an exchange option;
  • Cancel the affected item; or
  • Refund the amount paid for the unavailable item.

We are not required to substitute a product without your agreement.

5. Product Information

We take reasonable care to ensure that product descriptions, photographs, sizing information, materials, specifications and other information displayed on our website are accurate.

However, minor differences may occur between the way a product appears on a screen and the physical product, including differences caused by:

Any applicable shipping costs or other charges will be displayed before you complete your purchase.

We may change product prices from time to time. A price change will not ordinarily affect an order that has already been accepted.

We take reasonable steps to ensure pricing information is accurate.

If we identify a genuine pricing or listing error before an order has been accepted, we may contact you and:

  • Cancel the affected item or order and refund any amount already paid for it.

Promotions may be subject to additional conditions, including:

Promotional conditions will be displayed with the relevant offer where applicable.

Unless otherwise stated, promotional codes cannot be exchanged for cash.

We may withdraw or correct a promotion where there is a genuine error, technical problem, fraud or misuse, subject to applicable law and any rights already acquired by customers.

Payment methods may change from time to time.

Meribuy generally does not directly store your complete credit or debit card information.

You must provide accurate and authorised payment information.

If a payment is declined, reversed, disputed or flagged for security review, processing of your order may be delayed or suspended while the issue is assessed.

We currently do not accept direct bank transfers unless expressly stated otherwise.

9. Shipping and Delivery

Orders are delivered in accordance with our Shipping Policy.

Delivery times shown on our website are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Actual delivery times may be affected by matters outside our reasonable control, including:

  • Courier delays;
  • Public holidays;
  • Severe weather;
  • Transport disruptions;
  • Remote delivery locations; and
  • Other operational events.

Customers are responsible for providing a complete and accurate delivery address.

Where available, tracking information will be provided after an order has been dispatched.

10. Returns, Exchanges and Change of Mind

Meribuy provides a voluntary change-of-mind return policy in addition to your statutory rights.

Subject to the conditions in our Returns, Exchanges & Store Credit Policy:

  • Eligible online purchases may be returned for change of mind within 30 days;
  • Eligible in-store purchases may be returned for change of mind within 7 days; and
  • Approved change-of-mind returns may be resolved by exchange, store credit or a Meribuy gift card.

Cash refunds are generally not provided for change-of-mind returns.

Products must meet the eligibility requirements stated in our Returns, Exchanges & Store Credit Policy.

The above change-of-mind periods do not restrict your rights in relation to faulty, defective, unsafe or incorrectly described products.

11. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms, or in any other Meribuy policy, is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.

If a product fails to comply with an applicable consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law.

Depending on the circumstances and the nature of the failure, this may include:

  • Repair;
  • Replacement;
  • Refund; or
  • Compensation for reasonably foreseeable loss or damage.

Where you are legally entitled to a refund, Meribuy will not require you to accept store credit or a gift card instead.

Our voluntary return, exchange, warranty or store credit policies operate in addition to, and not instead of, your rights under the Australian Consumer Law.

12. Sale and Clearance Products

Sale or clearance products may be excluded from Meribuy's voluntary change-of-mind return policy where this is clearly stated.

However, purchasing an item on sale or clearance does not remove any rights you may have under the Australian Consumer Law if the product is faulty or otherwise fails to meet an applicable consumer guarantee.

13. Gift Cards and Store Credit

Meribuy may issue or sell gift cards, vouchers or store credits.

Specific conditions relating to their:

  • Use;
  • Redemption;
  • Validity;
  • Expiry;
  • Eligible products; and
  • Other restrictions

will be provided with the relevant gift card, voucher or store credit.

Gift cards will comply with applicable Australian gift card laws.

Unless required by law, gift cards and store credits are generally not redeemable for cash.

Store credit issued in connection with a return may be subject to the terms communicated when the credit is issued.

14. Customer Accounts

You may have the option to create a Meribuy customer account.

You are responsible for:

  • Providing accurate account information;
  • Keeping your information reasonably up to date;
  • Maintaining the confidentiality of your login credentials; and
  • Notifying us if you reasonably believe your account has been accessed without authorisation.

You must not create an account using false information or impersonate another person.

We may suspend or restrict access to an account where reasonably necessary to protect:

  • The customer;
  • Meribuy;
  • Other users;
  • Our systems; or
  • The integrity of transactions.

15. Fraud and Unauthorised Transactions

Meribuy may use fraud prevention and transaction verification measures.

Where an order is identified as potentially fraudulent or unauthorised, we may reasonably:

  • Delay processing;
  • Request additional verification;
  • Contact the customer;
  • Refuse the transaction; or
  • Cancel the order.

  • Unauthorised use of a customer's account caused by the customer's failure to reasonably protect their credentials; or
  • Third-party services that are outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in this section excludes or limits:

  • Australian Consumer Law rights;
  • Liability that cannot legally be excluded;
  • Remedies for major failures;
  • Liability for fraud; or
  • Other statutory rights that cannot lawfully be restricted.

24. Your Responsibility for Breaches

You are responsible for losses reasonably incurred by Meribuy as a direct result of your:

  • Unlawful use of the website;
  • Deliberate misuse of our systems;
  • Fraudulent conduct;
  • Infringement of third-party rights; or
  • Material breach of these Terms,

to the extent permitted by law.

Nothing in this section requires you to compensate Meribuy for losses caused by Meribuy's own unlawful conduct, negligence where liability cannot lawfully be excluded, or matters for which you are not legally responsible.

25. Suspension or Termination of Access

You may stop using the Meribuy website at any time.

We may suspend or terminate access to some or all of our website or services where reasonably necessary, including where:

  • These Terms are seriously or repeatedly breached;
  • Fraudulent or unlawful activity is suspected;
  • Website security is threatened; or

Termination does not affect rights or obligations that arose before termination.

Subject to any rights you may have to bring proceedings in another jurisdiction, the parties submit to the courts and tribunals having jurisdiction in New South Wales.
